The team of Trayvon Martin Peace Monitors formed by Los Angeles Urban Policy Roundtable President Earl Ofari Hutchinson and other civil rights leaders were credited by officials with playing a key part in preventing a reoccurrence of the disturbances that rocked the Crenshaw District Monday night. The Peace Monitors were on the streets at all potential trouble spots on Crenshaw Tuesday night and not one single disturbance or act of violence occurred.

“The Trayvon Martin Peace Monitors showed that civil rights leaders and concerned citizens in cooperation with city officials and the LAPD can stop civil disturbances in Los Angeles,” says Hutchinson, “Their actions serve as a model for community action in preventing future potential acts of civil unrest in Los Angeles.”

Defense Strategy to Put Trayvon Martin on Trial Has Successful Precedents

 Author and Nationally Syndicated Columnist Earl Ofari Hutchinson’s new book,  America on Trial: The Slaying of Trayvon Martin (Amazon Kindle) examines the issues of race and the criminal justice system in the Martin case. Hutchinson contends that the defense strategy to put Trayvon Martin not George Zimmerman on trial has been used successfully in the past. Defense attorneys in highly charged racial cases where the victims have been young African-Americans have time and again turned the tables and painted the victims as the culprits.

Hutchinson notes that defense attorneys used this tact in the Rodney King beating case in Los Angeles, the Sean Bell police killing in New York, and the killing by a transit police officer of Oscar Grant in Oakland.

Hutchinson says that prosecutors have a daunting job trying to overcome the negative racial stereotypes. Two Penn State University studies on racial perceptions and stereotypes, one in 2003 and a follow-up study in 2008, found that many citizens are likely to associate pictures of blacks with violent crimes, and in some cases where crimes were not committed by blacks they misidentified the perpetrator as an African American. Defense attorneys always play hard on any prior misconduct, bad behavior, or any criminal conduct by the victim.

Zimmerman’s attorneys, Hutchinson adds, have relentlessly played on this theme about Martin.  This feeds into the stereotype of bad behaving blacks, and that the victim somehow was responsible for the accused using deadly force.

 All Female Jury Could be a Plus for Zimmerman

Hutchinson notes that based on informal studies and the experiences of defense attorneys in major criminal cases an all-female jury could be a plus for George Zimmerman.

Hutchinson presents this summary of those findings regarding all-female juries:

* Women are more compassionate than men in most criminal cases, but they can be ruthless when it comes to sex crimes.

* Men tend to be harder on defendants.

* Women are sympathetic to mistreatment. As one seasoned criminal defense attorney noted, “Like black people, they are sensitive to injustice because they have had a lot of it put on them.”

Hutchinson adds that majority female juries came under much scrutiny and criticism for the acquittal verdict of O.J. Simpson. The criticism was not just that their decision to acquit Simpson allegedly was a race biased decision but also that female jurors were supposedly more sympathetic to the defense.

This may or may not be the case with Zimmerman, Hutchinson assures, but in an emotional trial with much Zimmerman’s defense attorneys relentlessly trying to paint Zimmerman as a victim of Trayvon Martin, the jury could be problematic for the prosecution.

 Danger of Racial Divide in Zimmerman Jury

Hutchinson notes that opinion polls and surveys on the Martin shooting have consistently shown that a majority of whites are ambivalent about the Zimmerman prosecution or support Zimmerman’s version of events in the shooting. On the other hand, Hutchinson notes, the same polls and surveys show that a majority of blacks believe that Zimmerman is guilty.

There is the strong likelihood that there will be some diversity in the final jury picked in the case. This could set up a prolonged battle to reach a verdict—if a verdict can be reached. A jury decision could be further muddled, Hutchinson adds, by the defense’s relentless effort to depict Martin as the aggressor in the shooting. This has angered many blacks and civil rights leaders who have closely monitored the case.

The one certainty, Hutchinson adds, is that race will overhang the many days that the prosecution and Zimmerman’s defense attorneys will do battle over who will and should be the final six jurors. That battle could continue into the jury room.

Hutchinson contends that sequestration in the Zimmerman trial could cause more problems than it solves. Hutchinson notes that informal surveys of the impact of jury sequestration on trial outcomes shows that isolating a jury can increase juror dropouts. Those with family responsibilities can’t stomach more than a few nights away from home, and they often end up leaving mid case due to “personal circumstances.”

Hutchinson also notes that these juror departures likely increase the likelihood of a mistrial. That’s the result of the eagerness of jurors to return home and that could compel them to deliberate hastily.

Hutchinson adds that jury sequestration is used in few cases and that includes high profile cases. The reason for this is precisely because of the risk of a costly, time consuming, and legally frustrating mistrial with sequestered juries. That’s certainly a major danger, Hutchinson, insists, with a jury sequestered possibly for weeks in the Zimmerman trial.

Will Gingrich Bring White Supremacy Back to the White House?


Put “President” in front of Newt Gingrich and there’s an even chance “white supremacy” could be put in front of his presidential moniker.  The suddenly surging Gingrich upped his racially loaded pandering scorecard with the resurface of a handwritten first draft of a series of talks he prepared in 1993 a couple of years before his ascendancy to House Speaker for his prescription for “renewing American civilization”. Gingrich initially scrawled that while Asians, and presumably whites, understood how to build businesses and acquire wealth, Latinos were sorely lacking in wealth and business acumen and blacks were even more hopelessly ignorant of what it took to succeed in the business world.

Gingrich cited no figures, studies, or research to document his blatant falsehood. But he really didn’t need to for two reasons. By the time a member of Gingrich’s staff typed up the notes and prepared the speech for delivery at the National Review Institute, the racially inflammatory digs had been scrubbed out. By the time he delivered the talks they appeared to be racially neutered and came off as just Gingrich pontificating on the his stock tout of free enterprise, personal strength and values, American resolve, and America’s alleged technological superiority.

The other reason Gingrich’s racial pandering passed under the public radar scope is that the GOP had long refined the art of racial code speak. So Gingrich simply entitled his talks “the five pillars of American civilization.” It was understood that talk of values, strength, enterprise, and technology punctuated with the caption “American civilization” was a not so subtle way of boasting of the alleged paramount role of whites in building American civilization and the alleged drain on building American civilization by Latinos, and especially blacks.
